Barrack Rodos Announces Suit Against New Era of Networks, Inc. and its Officers and Directors Alleging Misrepresentations

A class action was commenced in the United States District Court for the District of Colorado on behalf of all persons who purchased the securities of New Era of Networks, Inc. (Nasdaq:NEON) ("NEON" or the "Company") between October 18, 2000 and January 5, 2001, inclusive (the "Class Period").

The complaint charges that, throughout the Class Period, defendants violated Sections 10(b) and 20(a) of the Securities Exchange Act of 1934, and Rule 10b-5 promulgated thereunder, by issuing a series of material misrepresentations that artificially inflated the price of NEON common stock. Specifically, the complaint charges that during the Class Period defendants misrepresented that the Company had achieved record results for the third quarter 2000. The complaint alleges that defendants failed to disclose that nearly 20% of the "record" revenues was comprised of non-cash receipts of equity in a number of corporate customers of the Company in exchange for the Company's products.

The complaint also charges that after the character of the Company's revenues was revealed, the Company sought to assure the investment community that it remained comfortable with earnings projections when it knew that they were not achievable. The dissemination of this materially misleading information caused NEON's common stock to be artificially inflated throughout the Class Period. Defendants were motivated to inflate the Company's stock price in order to sell tens of thousands of their own shares to unsuspecting investors.

The plaintiff seeks to recover damages on behalf of all purchasers of NEON securities during the Class Period.
