SSH Communication Security comments on UK High Court Ruling

First instance UK Court rules against SSH

SSH Communication Security Oyj announces that the UK High Court of Justice has issued its judgment regarding patent EP (UK) 2 254 311 held by SSH. The High Court found that Sony Communications International infringes this patent, but that the patent is invalid in the UK. This judgment is based on the July 2016 trial.

“We are disappointed with the result but at the same time would like to emphasize that we do not agree with the validity ruling,” said Erkki Yli-Juuti, VP Intellectual Property of SSH. “We plan to ask the court for permission to appeal and have been advised that we have good grounds for appeal. SSH also continues its other licensing and litigation efforts with full force.”

SSH has pending separate litigations against Sony in Germany regarding the German counterpart of the same European patent. The UK and German litigations are separate and the current result from the UK litigation has no direct impact on the German case, which focuses on Sony’s alleged infringement of the patent. The decision from German litigation is expected during Q4/2016.

This UK decision covers only one SSH patent registered in the UK. Consequently, this decision has no impact on other UK and other national patents SSH holds and licenses.
