SSH Communications Security Patent found invalid by US Patent and Trademark Office

US PTAB Decides Against SSH

SSH Communications Security Plc. announces that the Patent Trial and Appeal Board (PTAB) of US Patent and Trademark Office (USPTO) has rendered its decision regarding patent US 8544079 held by SSH. The PTAB found that the patent is invalid. This judgment is based on proceedings triggered by a petition filed by Sony in 2015.

“We are naturally disappointed with the result.” said Erkki Yli-Juuti, VP Intellectual Property of SSH. “We are carefully studying the decision with our experts and will decide on next steps when we have the decision well analyzed.”

The decision relates only to one patent, and does not have any impact to other SSH patents. SSH has pending separate litigations processes against Sony in Germany regarding the German counterpart as well as in UK regarding the UK counterpart of the same patent. The UK and German litigations are separate from the US case, and the current result from the US litigation has no direct impact on them. Decisions from SSH appeal in the German litigation on infringement is expected during late 1H/2017 or early 2H/2017, and decision on the so-called nullity case on the validity of the German patent is expected during 2H/2017.
