Suresnes, April 11, 2018: the Arras Commercial Court has ruled in favor of Recylex S.A. by rejecting the claim for damages from the liquidators of Metaleurop Nord S.A.S. initiated in October 2014 for around €22 million of damages, corresponding to the statutory dismissal compensations paid to former employees of Metaleurop Nord S.A.S. in 2003 by the salary guarantee fund regime.
The Arras Commercial Court has decided today to consider the liquidators' claim inadmissible as being time-barred since March 21, 2013 on the one hand, and for not having been declared within the scope of the judicial recovery procedure of Recylex S.A. whilst their alleged receivable was born before its opening, on the second hand.
It should be recalled that the liquidators of Metaleurop Nord S.A.S. had already seen all of their previous legal proceedings against Recylex S.A. rejected at first instance, on appeal and in the Cour de Cassation.
Trading in Recylex shares (Euronext Paris: FR0000120388 - RX) will resume at the opening of the stock market trading session on Thursday April 12, 2018.
