RECYLEX SA: POSITIVE RULINGS BY THE DOUAI APPEAL COURT IN CONNECTION WITH 97 CLAIMS FOR DAMAGES FOR PREJUDICE OF ANXIETY


Suresnes, June 29th, 2018: Recylex S.A. (Euronext Paris: FR0000120388 - RX) duly notes the rulings handed down today by the Douai Appeal Court rejecting the claims for damages for prejudice of anxiety lodged by 97 former employees of Metaleurop Nord S.A.S. represented by the CGT union.

The Douai Appeal Court has overturned the Lens Labour Court decisions of 14th and 18th October 2016 by which Recylex S.A. was condemned to indemnify these 97 former employees of Metaleurop Nord S.A.S. up to a global amount of €1.2 million. These decisions were not enforceable by provision.

The Douai Appeal Court has stated today that the indemnification of a prejudice of anxiety can only be granted to former employees of a plant included on the list of facilities eligible for the early retirement allocation for asbestos workers ("ACAATA") and that the company Recylex S.A. was never included on such list.

As a reminder, the claims for damages brought by approximately 345 other former employees of Metaleurop Nord S.A.S. will be examined at the hearing of the Lens Labour Court scheduled for March 26th, 2019.
