Court Denies Qualcomm's Motion to Dismiss ParkerVision's Claims of Indirect Infringement


JACKSONVILLE, Fla., March 28, 2013 (GLOBE NEWSWIRE) -- ParkerVision, Inc. (Nasdaq:PRKR) announced that in a Court Order filed today, the U.S. District Court in the Middle District of Florida, has denied Qualcomm's Motion to Dismiss ParkerVision's claims of indirect infringement in its patent infringement litigation against Qualcomm, Incorporated (Nasdaq:QCOM).

This is the second time the Court has been asked to determine whether ParkerVision's complaint sufficiently alleges facts in support of its claims that Qualcomm indirectly infringed the claims of six of ParkerVision's United States patents. On August 23, 2012, the court granted Qualcomm's previously filed motion to dismiss ParkerVision's claims of indirect infringement, citing a federal appeals court ruling, which had changed the pleading requirements subsequent to ParkerVision's initial pleading. The court allowed ParkerVision to amend its pleadings to conform to the new rules. In September 2012, ParkerVision filed an amended complaint modifying its indirect infringement pleadings. In today's ruling, the Court agreed that ParkerVision satisfied the new pleading standards resulting in a denial of Qualcomm's motion to dismiss ParkerVision's claims of indirect infringement.
