SEATTLE, March 8, 2010 (GLOBE NEWSWIRE) -- Attorney Advertising. Keller Rohrback L.L.P. (http://www.krclassaction.com) announces that it is investigating possible claims against POM Wonderful, LLC, ("POM") regarding its advertisements claiming disease-prevention and curative benefits of products containing pomegranate juice or extracts. POM is a manufacturer of pomegranate juice, pomegranate juice blends and POMx antioxidant-enhanced products.
On February 23, 2010, the Food and Drug Administration issued a warning letter to POM for making impermissible health claims about its 100% pomegranate juice and POMx pill and liquid products. The letter stated: "The therapeutic claims on your website establish that the product is a drug because it is intended for use in the cure, mitigation, treatment, or prevention of disease. The marketing of this product with these claims violates the [Federal Food, Drug and Cosmetic Act, 21 U.S.C. Section 301, et seq.]." In an open letter to the food industry on March 3, 2010, FDA Commissioner Margaret Hamburg noted that recently-issued FDA warning letters, including the letter addressed to POM, "cover a range of concerns about how false or misleading labels can undermine the intention of Congress to provide consumers with labeling information that enables consumers to make informed and healthy food choices." The FDA voiced concerns about "[p]roducts that claim to treat or mitigate disease" and "[m]isleading "healthy" claims ... that do not meet the long- and well-established definition for use of that term."
Products under investigation include, but are not limited to, the following:
- POM Wonderful 100% pomegranate juice;
- POM Wonderful pomegranate juice blends;
- POMx Antioxidant Pills;
- POMx Shots (liquid supplements);
- POMx Antioxidant Super Teas;
- POMx Bars; and
- POMx Iced Coffees.
